Terms of Sales
Article 1 - Scope
The general conditions of sale described below (hereinafter "the general conditions of sale) are intended to govern all contractual relations between the SAS ALTIFLORE with capital of 100,586.45 euros, whose head office is located in Les Estèves 05260 CHABOTTES - RCS GAP - 415 277 334; Intra-community VAT number FR01415277334 (hereinafter “ALTIFLORE” or “We”) and customers over the age of 18 and benefiting from full legal capacity (hereinafter “The Customer” or “You”) ordering by through the Site www.altiflore.com (hereinafter "the Site").
The General Conditions of Sale apply without restriction or reservation to the whole sales of products appearing on the Site.
Placing an order through the Site implies unreserved acceptance of the General Conditions of Sale by the Customer. ALTIFLORE reserves the right to modify these General Conditions of Sale at any time. ALTIFLORE therefore invites you to carefully read the General Conditions of Sale with each new order placed. The applicable General Conditions of Sale will be those in force on the day the order is placed.

Article 2 - Your order
The order of the products that you select (hereinafter the “Products”) will be carried out according to the process described below.
2.1. Your identification:
You access the contents of your basket, including all the Products. You must then proceed to your identification. As such, you agree to provide ALTIFLORE with accurate and reliable information, thus enabling us to perform all of our contractual obligations.
ALTIFLORE cannot be held liable in the event that the information you have provided turns out to be false or incomplete. In this context, or in the event of non-payment or any other irregularity in your account, ALTIFLORE reserves the right to cancel your order and / or delete your user account. Your identification can be made directly after selecting the Products or through your user account (hereinafter the “Account”). Opening an Account involves entering two identifiers: an email address and choosing a password. Your identifiers are personal to you and must be kept confidential.
You can access the personal data that you have communicated to us on simple request, in accordance with the provisions of the article Data Personal General Conditions of Sale.
2.2. Placing your order:
Once the products have been selected and your identification data entered, you then proceed to the selection of your method of payment. A summary of your order is then presented to you, which will include in particular information relating to the Products, prices or delivery terms. You will also be assigned an order number.
2.3. Final confirmation of your order:
Once the order has been confirmed, the final validation of your order will take place when the debit bank authorization has been given to ALTIFLORE. A final confirmation will then be sent to you, including all the elements relating to your order.
Only the final validation of the order commits ALTIFLORE to the Customer.
Your invoice will be sent to you by email after receipt of your package.
2.4. Product availability:
The Products are offered to the Customer within the limits of available stocks. Thus in the event of unavailability of the Product ordered, ALTIFLORE undertakes to inform the Customer as soon as possible and will reimburse the Product (shipping costs included) within a maximum period of 30 days. In this case, ALTIFLORE will cancel and refund your order.
Article 3 - Product prices:
The prices indicated on the Site are indicated "All Taxes Included" ( TTC). Unless otherwise indicated, the prices indicated do not include shipping costs.
Article 4 - Payment of your order
By bank card: by entering your bank details from the Site. All bank details entered are processed securely and are immediately encrypted. This Information is only accessible to our banking partner, so that they can get in touch with your bank. At no time, ALTIFLORE or any other third party, can access your banking data. Your payments are sent to our banking partner on the day of the order.
When confirming your order, we take the imprint of your credit card. It is only debited when your order is shipped or no later than 6 days after your order has been confirmed.
Article 5 - Security of your means of payment
In order to guarantee maximum security when ordering, all payments by bank cards are secured by the system offered by 3D Secure. This system is based on cryptographic techniques thus ensuring the confidentiality and integrity of exchanges. Thus, when entering your bank details (card number, validity date and code), they are automatically encrypted and sent in secure mode to a server.
At the same time, ALTIFLORE sends this same server, always in secure mode, data specific to your order (transaction number, order amount). The system offered by 3D Secure checks the card and requests authorization from your bank using a private banking network. The 3D Secure system sends back the confirmation of payment and sends you back to the Site. The 3D Secure system then takes care of the payment to our banking partner.
Article 6 - Delivery of your order
Insured deliveries by ALTIFLORE are limited to Metropolitan France (excluding Corsica).
The delivery times applicable in the context of Product Orders via the Site are those indicated during of the Order, before its validation.
These times are likely to vary in particular according to the place of delivery, the chosen delivery method, the quantity of Products ordered and their availability. The delivery times announced during the Order are indicated in working days and subject to validation of the Order.
The Products are delivered by ATIFLORE to the delivery address indicated by the Customer or in the Relay point he has chosen.
If all or part of the addresses or information necessary for delivery provided by the Customer, during the Order, prove to be incorrect, obliging ALITLORE to return the Order, it will be up to the Customer to bear the costs and consequences.
Deliveries are made by Chronofresh directly at your address or at the relay point of your choice.
Article 7 - Guarantees
The Customer is required to carefully check the condition and conformity of the Products delivered upon delivery.
In the event of non-compliance or missing products, it will be up to the Customer to inform ALTIFLORE by e-mail at the following address: firstname.lastname@example.org within 48 hours of receipt with supporting photo.
Article 8 - Right of withdrawal
In accordance with the regulations in force regarding fresh products, these products cannot be returned due to their nature.
Thus the products cannot be returned in order to prevent any deterioration or expiration.
They are therefore neither returned, neither exchanged, nor refunded.
Article 9 - Liability
ALTIFLORE cannot be held liable if the Customer does not comply in whole or in part with the General Conditions of Sale or in the event of an unforeseeable act of a third party or in the event of force majeure.
ALTIFLORE may in this regard case to be exempt from all or part of its responsibility by providing proof of the non-performance or improper performance of these General Conditions of Sale, either when this is attributable to the Customer, or when it is the unforeseeable and insurmountable fact of a third party to the contract or then following a case of force majeure recognized as such by case law.
Article 10 - Retention of title
The delivered goods remain the property of ALTIFLORE until full payment of their price. Failure to pay may result in claiming the goods. The transfer of the risks of loss or deterioration is carried out in the hands of the Customer from the delivery of the products.
Article 11 - Data personal
ALTIFLORE attaches great importance to the protection and respect for the privacy of its Customers and their personal data. The personal data protection policyALTIFLORE aims to inform Customers of practices concerning consent, collection, use, storage, security measures, retention period (s), recipient (s) and sharing of personal data that the Customer is required to provide when making a purchase by creating an account.
The personal data protection policy is available on the Website by ALTIFLORE in the “Confidentiality Policy” section.
Thus, ALTIFLORE protects the privacy of its Customers by respecting the legislation in force and by following its internal rules relating to the protection of personal data.

In order to allow ALTIFLORE to satisfy them, each request must be accompanied by the elements necessary to identify the sender: name, first name, email and possibly address postal.
Article 12 - Dispute management

Article 13 - Applicable law and competent court
These General Conditions of Sale are subject to French law. In the event of a dispute, an amicable solution will be sought beforehand. Any dispute relating to the execution of these Conditions will fall under the exclusive jurisdiction of the French courts.
